Enterprises with a Workplace Agreement in place will continue to operate from the Agreement and not the Horticulture Award 2010. However, where a provision in the Agreement provides a lesser entitlement in comparison with the NES, the entitlement under the NES will apply. In addition to this, the base rate of pay in the Agreement (the permanent weekly/hourly rate) will not be less than the rate contained in the Horticulture Award 2010. The exception to this relates to casual loadings in workplace agreements. Where an agreement provides for a 23 per cent causal loading, this can continue to apply despite the horticulture award containing a 25 per cent loading.
